Manachart, a cloud-based software platform, is owned and operated by Manachart, LLC ("Manachart", "Us", or "We"). We provide the Manachart website and various related services (collectively, the "Service") to You, the user, subject to Your compliance with all the terms, conditions, and notices contained or referenced herein (the "Terms of Use" or "Terms"), as well as any other written agreement between Us and You.
By using the Service, you agree to be bound by these terms of use. Your remedy for dissatisfaction with Manachart or the Service, is to stop using the Service. Your agreement with us regarding compliance with these terms of use becomes effective immediately upon commencement of your use of the Service.
Manachart reserves the right to update or modify these Terms at any time without prior notice. Updated Terms of Service can be found at this web location. You understand and agree that Your continued use of the Software after any such changes constitutes your acceptance of the new Terms.
By accessing the Site, You are also agreeing to be bound by all applicable laws and regulations, and agree that You are responsible for compliance with any applicable local laws. The materials contained on the Site are protected by applicable copyright and trade mark law.
Manachart reserves the right to block access by a user or group and/or delete any and all of their content if their content is considered harmful to the Site, Manachart LLC, or our partners, or the user violates these Terms of Use. False representation during registration or use of the Site is a violation of these Terms.
Manachart Service requires the Account Owner to create an AWS Account, which is paid for and maintained exclusively by Account Owner on behalf of the Organization. Medical records will be stored on both Manachart servers and on the Account Owner's AWS Account. Security, cost, and maintenance for AWS account is the responsibility of Account Owner. The cost of AWS account is billed separately to Account Owner directly by AWS. Failure to maintain this account will result in Manachart Service not being able to store records or function properly. In this situation, access to Manachart Service may be curtailed or denied.
Protection and privacy of PHI is Your responsibility. Creation and safe storage of a strong password and logging out of the Site when not in use are required to maintain security of PHI. Manachart is not responsible for the inadvertent or intentional disclosure of such records by the user.
We do not make any claims of accuracy, reliability, integrity of the Site or its contents.
Manachart reserves the right to modify or discontinue features or functionality of the Service from time to time for any reason, at its sole discretion. Updated Terms can be found on this website.
You agree that Manachart shall not be liable for any damages arising out of or in connection with the use of the Service. This limitation of liability includes, but is not limited to, damages for lost profits, lost data, patient or provider harm, business interruption, or any other damages caused by the User's use of the Service.
If any provision of these terms of service is held to be invalid or unenforceable, such provision shall be struck from these terms of service and the remaining provisions shall remain in full force and effect.
The materials appearing on the Site could include technical, typographical, or photographic errors. You accept that Manachart does not warrant that any of the materials on the Site are accurate, complete, or current.
You accept that the Site employs the use of "cookies", which are tokens placed on computers/devices that access it for security and authentication purposes.
Any claim relating to the Site shall be governed by the laws of the State of Hawaii without regard to its conflict of law provisions.
We take reasonable precautions and follow industry best practices to ensure personal information is not lost, misused, accessed, disclosed, altered or destroyed.
Payment transactions for the Manachart service is handled by our partner payment gateway (Stripe, Inc). We do not transmit or store credit card information.
Manachart is a paid, subscription-based service. Initial payment is required to complete registration. An invoice at the beginning of each billing cycle thereafter will be for the cost of the subscription plan. If payment is not obtainable from available payment methods, account access will be limited or discontinued. Multiple instances of non-payment may result in account termination.
It is Your responsibility to ensure You have a viable payment method available and that Your subscription plan is sufficient to allow for the number of users in Your Organization. Subscription price and payment policy are subject to change.
The Account Owner may voluntarily transfer the role and protection and access it confers to another Organization Member. Should the Organization require transfer of the Account Owner role because of incapacitation, death or other reason that renders the Account Owner unable to voluntarily transfer the role, the Organization will contact Manachart and identify the individual to whom to transfer the Account Owner role. IT IS HIGHLY RECOMMENDED THAT A CLEAR LINE OF SUCCESSION OF THE ACCOUNT OWNER ROLE IS IN PLACE WITHIN THE ORGANIZATION IN PREPARATION FOR UNFORSEEN CIRCUMSTANCES THAT MAY REQUIRE TRANSFER OF THE ROLE.
Manachart makes no claim of providing "certified" software. Our software meets all applicable laws but may not be compatible with old, current, or future incentive and/or penalty programs implemented by government or private agencies.
Manachart uses SMS and Email to provide users with multi-factor login authentication and to provide critical security notices. It is the user's responsibility to ensure they are able to receive these notifications.
